Terms of Service

These terms are the agreement between you and WakeCards. By creating an account or using the service, you accept them. If you do not accept them, do not use the service.

1. Who we are

WakeCards ("the Service", "we", "us") is an independent software project that turns documents you provide into question-and-answer flashcards. You can reach us at 43137888@qq.com.

2. What the Service does

You upload a document you have the rights to use. The Service sends the selected text to a third-party AI model to draft flashcards, which you then review, rate, and repeat. The Service also keeps your generated cards in your account so you can study them later.

The Service is a study aid, not a source of truth. It does not read the whole document at once, it can misread a passage, and it can produce a card that is wrong or misleading. Check anything important against your original source.

3. Your account

• You must be 18 or older to use the Service.
• You are responsible for keeping your password and recovery code safe. Anyone with them can access your account.
• You are responsible for everything done through your account.
• Provide an email address you actually control. We use it for sign-in, verification, and password recovery.
• One person, one account. Do not share an account or resell access.

4. What you may upload

You may only upload material you have the right to use — your own notes, documents you bought, or material you are licensed or permitted to copy. Do not upload:

• material you do not have the rights to, including pirated textbooks, leaked exam papers, or paywalled content you did not pay for;
• other people's personal data without their permission;
• anything unlawful, or that infringes someone else's copyright, trademark, or privacy.

You keep all rights to your own documents. You give us only the limited permission needed to store them, process them, and show your cards back to you.

5. Acceptable use

Do not:

• attempt to break, overload, or bypass the Service, its limits, or its authentication;
• scrape, resell, or redistribute the Service or its output as a competing product;
• use automated means to create accounts or consume credits;
• use the Service to build a database of copyrighted exam or test content.

We may suspend or close an account that breaks these rules. Where a refund is due under section 8, closing an account for a breach does not remove that obligation.

6. Credits and limits

Generating cards consumes credits. One credit covers one PDF page or one 2,000-character section, counting a partial section as a full one. New accounts receive a free starting allowance; we may change how many credits we grant, and we may change credit prices, at any time. Changes never apply retroactively to credits you already bought.

Credits have no cash value, cannot be transferred between accounts, and are not a security or a stored-value instrument.

7. AI output

Card text is generated by a third-party AI model. We do not guarantee that it is accurate, complete, or suitable for any particular exam, course, or purpose. The Service is not medical, legal, financial, or professional advice. Do not rely on it for decisions with real consequences.

8. Paid credits and payments

Some features may require paid credits. If you buy credits:

• Who you are buying from. Payments are handled by a third-party Merchant of Record ("MoR"). The MoR is the legal seller for the transaction: it takes your payment, issues your receipt or invoice, collects and remits any applicable sales tax or VAT, and handles refunds. Your card statement will show the MoR, not WakeCards.
• Payment methods. The MoR decides which payment methods are available, which typically includes major credit and debit cards.
• Failed generations. If a generation fails for a reason on our side, we will restore the credits that were consumed. Tell us at 43137888@qq.com and we will fix it.
• EU/UK consumers. You normally have 14 days to withdraw from a digital purchase. By buying credits and starting to use them, you ask us to begin supplying the digital content immediately, and you acknowledge that you lose the withdrawal right once supply has begun. This does not affect your rights if the content is faulty.
• Other refunds. Outside the cases above, unused credits are refundable at our discretion within 14 days of purchase. Contact us first — refunds go through the MoR, so we cannot process them ourselves.

The Service itself is currently free to use within the free allowance. Nothing on the site is an offer to sell credits until a payment flow is actually available.

9. Our intellectual property

The Service, its design, and its source code are ours or our licensors'. These terms do not transfer any of that to you. They also do not transfer any rights in the documents you upload — those stay yours.

10. Availability and changes to the Service

We may add, change, or remove features. We may also take the Service down for maintenance. We aim to keep it running, but we do not promise uninterrupted or error-free availability.

If we discontinue the Service, we will give reasonable notice by email and, where it is technically possible, a window in which to retrieve your cards.

11. Suspension and termination

You may stop using the Service at any time and ask us to delete your account (see the Privacy Policy). We may suspend or terminate your access if you materially breach these terms, if we are legally required to, or if continuing to serve you would put the Service or other users at risk.

12. Disclaimers

The Service is provided "as is". To the extent the law allows, we disclaim all implied warranties, including fitness for a particular purpose and accuracy of AI output. We do not warrant that the Service will improve your grades, exam results, or recall.

13. Limitation of liability

To the extent the law allows, our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50. We are not liable for indirect or consequential loss, lost data that you did not back up, or lost profits.

Nothing in these terms limits liability that cannot lawfully be limited, and nothing here removes mandatory consumer rights in your country of residence.

14. Changes to these terms

We may update these terms. If a change is material, we will tell you by email or in the app before it takes effect. Continuing to use the Service after that means you accept the new version. The "Last updated" date at the top always shows the current version.
